Protection of personal data
The Austrian Energy Agency respects the privacy of users. All information is treated confidentially in accordance with the applicable data protection regulations (DSGVO, DSG, TKG). Data will not be passed on to third parties without your consent. Data processing is carried out in any case and in accordance with the applicable legal situation on the basis of the statutory provisions of § 96 para. 3 TKG and Art. 6 para. 1 lit. a (consent) and/or f (legitimate interest) of the GDPR.
The Austrian Energy Agency collects personal data only to the extent necessary for a specific purpose. The data will not be used for any incompatible purpose. Although you can view most websites without providing any personal information, in some cases personal information is required in order to provide the online services you have requested.
An online service on this website is a tool provided on the Internet to improve communication between citizens and businesses and the Energy Agency.
On Internet pages for which such information is required, information on the use of your data is provided in the respective notices.
Contact with us
If you contact us, your data (first name, surname, e-mail address and telephone number) will be stored by us for six months for the purpose of processing the enquiry and in the event of follow-up questions, unless other legal bases specify other periods.
Cookies
We use cookies to personalise content and advertisements, to be able to offer functions for social media and to analyse access to our website. We also share information about your use of our website with our social media, advertising and analytics partners. Our partners may combine this information with other data that you have provided to them or that they have collected as part of your use of the services. Integration of social media platforms
You can contact Twitter, Facebook, LinkedIn, Xing and YouTube on this website. Only when you click on the corresponding buttons will contact be made with the respective server of these platforms and data transmitted. After opening the social media service, AEA has neither influence on the use of cookies nor access to the data collected there.
Newsletter
If you would like to receive our newsletter, we require your e-mail address, first name and surname and, if possible, further information about your company, as well as your consent to receive the newsletter. We use your data exclusively for sending the requested information.
Our processors are subject to contractual obligations regarding data protection-compliant use and process personal data on our instructions and only to the extent necessary.
You can revoke your consent to the storage of your data and e-mail address and their use for sending the newsletter at any time, for example by clicking on the "Unsubscribe" link in the newsletter.
Events
If you register for events that we organise, we will process the personal data you provide (email, name, company) in order to place you on the guest list for our event as requested. This data is required for administration purposes and may be processed by external processors. If you do not wish to receive any further event invitations, you can unsubscribe at any time by e-mail at datenschutz(at)energyagency.at or in the respective event invitation.
Data security
We do our utmost to make your visit and use of our website as secure as possible. We therefore comply with the provisions of Article 32 GDPR to ensure the confidentiality and security of your personal data and take appropriate technical and organisational security measures.
Image & video material
We process the photos and videos taken during our events, in which you can be seen directly or in the background, for follow-up reporting based on legitimate interests for press releases, our newsletters, publications and information brochures as well as for the online presence of the Austrian Energy Agency (including social media channels). As a data subject, you can object to this use of your data at any time.
Information about your rights
You have the right to obtain information about the data we hold about you. In addition, you can submit requests to correct your data or restrict the processing of your data if there are any ambiguities that need to be clarified. You can object to the processing of your data. You can submit a request for the deletion of your data. You can request the transfer of your data in a machine-readable format. You can submit a request against exclusively automated decision-making, except in cases of processing based on consent, contract or existing legal bases for processing.
You can withdraw any consent you have given. The consequences may be that the interests you have communicated are not processed.
Duration of storage of personal data
Business transactions in general
For tax and corporate law reasons, business-related documents must be stored for 7 years in accordance with § 132 BAO and §§ 190, 212 UGB.
Recruiting and employment relationships
In addition to the Equal Treatment Act and the Disability Employment Act, which each stipulate a 6-month retention period, the three-year retention period pursuant to Section 1486 of the Austrian Civil Code (ABGB) must generally be observed due to possible reciprocal claims for damages following unsuccessful job interviews.
During and after the employment relationship, various specific retention periods must be taken into account in addition to the retention period of 7 years resulting from wage tax and tax obligations in accordance with § 132 para. 1 BAO, up to the general retention obligation of employment data of 30 years in accordance with § 1478 ABGB.
Procurement procedure
Irrespective of the requirements under public procurement law to retain data from the award procedure for at least three years or, in the case of the subsequent contractual relationship, for the term of the contract, the long limitation period under civil law of 30 years pursuant to Section 1489 ABGB must be observed for retention in accordance with the judgement of the ECJ of 26 November 2015, Case C-166/14, MedEval.

Such personal data will be deleted after completion of the triggering process.
Data in connection with processing by the public sector
In connection with processing activities of the federal government, data must be stored for 10 years in accordance with Section 25 (3) of the Office Regulations, unless the specific content of the file or legal provisions require longer storage (Federal Archives Ordinance).
